Swimming Pool Certificates
Swimming pools and spas are a place of great enjoyment and fun in the home, however they also come with risks, so it's important to have adequate safety measures in place.
Pool or spa registration
All pools that are capable of being filled with 300mm or more of water and are used, designed, manufactured, or adapted for swimming, wading, paddling or any other human aquatic activity must be registered on the NSW Swimming Pool Register.
You will be provided with a Certificate ofRegistration once you’ve completed the process.
There are penalties for non-compliance under the Swimming Pools Act 1992, including being issued an infringement notice or facing court-imposed penalties, with a maximum penalty of $2,200.
Swimming pool barrier safety inspections
Swimming pool and spa owners are required, by law, in certain circumstances, to have their pool barrier inspected to ensure it meets the safety requirements.
You must have your pool barrier inspected if:
- You are selling or leasing your property
- You are a provider of tourist or visitor accommodation, including hotels, motels, Airbnb, or a strata title property (i.e. a property where there are two or more residences on a property) your pool barrier must be inspected every three years
- Your property is selected to be inspected by Council
- Council receives a complaint about your pool barrier
An inspection must be organised through your local Council or a registered certifier. If your pool complies with the safety standards, you will be issued with a Swimming Pool Certificate of Compliance which is valid for 3 years.
There are penalties for non-compliance under the Swimming Pools Act 1992, including being issued an infringement notice or facing court-imposed penalties, with a maximum penalty of $5,500.

🔒 Important Pool Safety Update
Attention Pool Owners!
Have a swimming pool gate with a locking mechanism similar to the one in the picture?

It's crucial to be aware: When the gate is ajar the key can be turned and the gate inadvertently locked. This will prevent the gate from latching and will allow unsupervised access to the swimming pool.
Your pool safety matters! Get in touch with Council’s swimming pool inspector today to discuss how this issue may impact the safety of your swimming pool. Protect your loved ones by ensuring your pool gate operates securely at all times.
Register your pool or spa on the NSW Government's online Swimming Pool Register. It's free and only takes a couple of minutes!
Section 22 of the Swimming Pools Act 1992 allows for an applicant to apply for an exemption to the required swimming pool barrier requirements on the grounds;
- That it is impracticable or unreasonable because of the physical nature of the premises
- Because of the design or construction of the swimming pool,
- Because of special circumstances of a kind recognised by Clause 14 of the Swimming Pool Regulations 2018 as justifying the granting of an exemption for the swimming pool to comply with those requirements
- That alternative provision, no less effective than those requirements, exists for restricting access to the swimming pool
A $250 fee applies and must be paid at the time of submitting the application.
