Serving a subpoena

Subpoenas must be addressed correctly to ensure they can be accepted and processed.

Subpoena for production

Address the subpoena to:

A subpoena for production that is not addressed in this way may not be accepted.

Subpoena to give evidence

If requiring a Council officer to attend court, address the subpoena to the specific Council officer required to give evidence in their capacity as an officer of Council.

Timeframes

Allow sufficient time

Please allow a minimum of 14 days before the return date for Council to locate, identify and prepare documents requested under a subpoena for production.

If Council cannot comply by the return date, we will contact you or the Court before the due date to request an extension where appropriate.

Fees and charges

The following fees apply to processing subpoenas.

Additional charges may apply for:

  • photocopying documents
  • reasonable costs associated with producing records
  • attendance of a Council officer to give evidence, charged at the officer's hourly rate plus travel and parking expenses.

Describing the documents

A clear and specific description of the documents required helps Council locate records efficiently.

Broad or unclear requests:

  • may take longer to process
  • may increase processing costs
  • may require clarification before records can be produced.
